On or about February 18, 1800, at Southampton County, Virginia, Chancery Court File 1821-028, Pretlow v. Judkins, a summons was issued against the heirs of Jordan Judkins to answer a complaint by William Urquhart and Thomas Pretlow: "The Commonwealth of Virginia to the Sheriff of Southampton county greeting You are hereby commanded to summon Sarah Judkins widow & relict of Jordan Judkins, William Judkins, Martha, Samuel, Rebecca, Cherry, Gray, Bynum & Jordan Judkins Coheirs of the sd Jordan Judkins to appear before the Justices of our sd. county court at the cthouse of the said county (sitting in Chancery) on the third monday in March next to answer a bill in chancery, exhibited against them by Wm. Urquhart & Thomas Pretlow & this they shall in no wise omit under the penalty of £100 cash and have then there this writ witness S Kello clerk of our sd. court at the Cthouse the 18th day of Feby. 1800 & in the 24th Year of the Commonwealth

 In April 1800, at Southampton County, Virginia, Chancery Court File 1821-028, Pretlow v. Judkins, Thomas Pretlow and William Urquhart filed their bill of complaint against the heirs of Jordan Judkins for payment of a debt secured by a mortgage on the land of Jordan Judkins: "To the justic[torn]thampton in Chancery sitting

 Thomas Pret[torn] & William Urquhart complaining shew that on the day of in the year 179 they became jointly bound in a bond for the sum of £500.0.0 with one Jordan Judkins, now deceased, as his security, to one John Gaultney. That the sd Judkins being seized & possessed of certain tracts or parcels of land situate & lying in the county aforesaid containing by estimation 706 acres more or less, in order to indemnify your complnts from all damage they might sustain by being bound as aforesaid and in further consideration of the sum of one dollar paid by your Comp[torn] the sd Judkins did execute a certain deed, called a mortgage, empowering your Complnts to make sale of the conveyed premises at any time after your Complnts shall have sustained any loss or injury by being bound as security as aforesaid. Your Complnts further state that they have been compelled to pay the sd sum of £500.0.0 the amt of the sd bond. - which bond & deed of mortgage your Complnts pray may be made part of this their [torn] Your Complnts are advised that notwithstanding [torn] & unsafe for them to dispose of the sd lands without a decree of a court of Equity. In consideration whereof and as estates in trust are properly cognizable in a court of Chancery to the end that Sarah Judkins widow of the sd Jordan Judkins deceased & William Judkins, Martha Judkins & Samuel, Rebecca, Charity, Gray, Binum & Jordan Judkins by Sarah Judkins & Sarah Judkins in her own right heirs & distributees of the sd Judkins may be [torn] defendants to this bi[torn] may [torn] make to the allegations contained & the [torn] court decree the sd def[torn] to pay & satisfy your Complnts the sd [torn].0.0 & interest with all costs & damages, expences & charges that have accrued or that may accrue relative to this business or in default thereof the sd defendants be decreed to deliver up the sd Lands to your Compplnts that sale may be made thereof and that sd defendants & all persons claiming under them may be foreclosed of & from all equity of Redemption upon closing in or to the sd Lands & that the estate of your orators, or purchasers thereof may become absolute therein, or that your Complnts may have such relief as is consistent with equity

 The defendants saving & reserving to themselves every exception to the many imperfections in the complnts bill mentioned Answer & say - that true it is that the complnts did become securities for Jordan Judkins to one John Gualtney in the manner & form as the bill states. That they believe the complnts have suffered by standing security for the sd Judkins decd & [torn] the complnts shou'd indemnify themselves by making sale of the land provided tis done by the sanction of the court
